Terms governing use of the ost.agency website. Engagement-specific terms (master service agreements, statements of work, data processing agreements) are governed by your contract.

Section 01
Scope and acceptance
These Terms of Service govern your use of the OpenSource Technologies website (ost.agency) and the publicly available information, content, and tools we make available there. By using the website, you agree to these terms.
If you have an active engagement with OST, your Master Service Agreement (MSA), Statement of Work (SOW), and Data Processing Agreement (DPA) take precedence over these website terms for matters relating to that engagement.
Section 02
Use of the website
You may use ost.agency for lawful purposes consistent with these Terms.
You agree not to:
- Use the website to transmit unlawful, harmful, or fraudulent content
- Attempt to access systems, accounts, or data beyond what is publicly available
- Probe, scan, or test the vulnerability of the website without prior written consent
- Scrape or systematically extract content for commercial use without permission
- Impersonate OST or any other person or entity
- Use the website in any manner that could disable, damage, or impair the website
OST may suspend or restrict access to the website for users who violate these Terms.
Section 03
Intellectual property
The ost.agency website, its content, and the trademarks "OpenSource Technologies," "OST," and related marks are the intellectual property of OpenSource Technologies, Inc. or its licensors.
Limited license to use the website is granted to visitors for the purpose of evaluating OST as a potential vendor, reading published case studies and articles, and submitting inquiries. No license is granted to copy, reproduce, modify, or distribute content beyond personal evaluation use without written permission.
For engagement-delivered work product (custom software, deliverables produced under contract), intellectual property terms are governed by the engagement contract and statement of work, not by these website Terms.

Disclaimers
The ost.agency website is provided "as is" and "as available." OST makes no warranty that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Content on the website (case studies, blog posts, capability statements, industry pages) is provided for informational purposes. While OST takes reasonable care to ensure accuracy, content may contain errors, omissions, or out-of-date information.
Statements about engagement results are accurate to the best of OST's knowledge but should not be construed as guarantees of similar results in other engagements.
Section 05
Limitation of liability
To the fullest extent permitted by applicable law, OpenSource Technologies, Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to use of the ost.agency website.
OST's total liability for any claim related to the website is limited to the greater of (a) $100 USD or (b) the amount you have paid OST for any product or service through the website (which is typically $0, as the website itself is free to use).
For active engagement liability, the engagement contract sets liability limits, indemnities, and dispute resolution. These website Terms do not modify the engagement contract.

Third-party links
The ost.agency website may contain links to third-party websites (such as YouTube for video testimonials, Clutch for client reviews, third-party blog references, and partner websites). These links are provided for convenience.
OST does not control third-party websites and is not responsible for their content, privacy practices, or security. Linking to a third-party website does not imply endorsement.

Changes to these Terms
OST may update these Terms of Service from time to time. The "Last reviewed" date at the top of this page reflects the most recent revision.
Material changes will be communicated through the website. Continued use of the website after changes constitutes acceptance of the updated Terms.
Section 08
Governing law and disputes
These Terms of Service are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws principles.
Any disputes arising from these Terms or use of the website will be resolved in the state or federal courts located in Pennsylvania, except where applicable law provides otherwise.
For engagement-related disputes, the engagement contract governs (governing law, venue, dispute resolution mechanism). These website Terms do not modify engagement-level dispute provisions.
